YOUR ARTWORK

By uploading or submitting any material (including images, designs, logos, or text—collectively referred to as “Artwork”) to complete an order with Blue Asterisk*, you (“You”, the customer) confirm that you have the legal right to do so and that the Artwork does not infringe upon the rights of any individual or entity. If you are a business customer, you agree to fully indemnify and hold Blue Asterisk* harmless against any claims, losses, legal fees, or expenses arising from third-party allegations that the Artwork violates their rights. Blue Asterisk* reserves the right to place your order on hold if further proof of usage rights is deemed necessary.

You must not upload or submit any Artwork for customisation that Blue Asterisk*, in its sole discretion, considers to be:

  • Inaccurate, defamatory, obscene, offensive, indecent, pornographic, abusive, blasphemous, hateful, threatening, inflammatory, or an invasion of privacy;

  • Likely to cause annoyance, distress, embarrassment, or inconvenience to others;

  • Discriminatory on the basis of race, gender, religion, nationality, disability, sexual orientation, or age;

  • Misleading or impersonating others;

  • Supportive of violence, illegal activities, or infringing on intellectual property or other legal rights;

  • Misrepresenting your identity or falsely implying affiliation with Shirt Monkey;

  • Containing personally identifiable information (e.g., address, phone number, email) without the explicit consent of the individual.

You must own the copyright to the Artwork or be fully licensed by the copyright holder to use it on products, and ensure it does not violate trademarks or confidentiality agreements.

These terms form part of our “Personalisation Standards.” Blue Asterick* reserves the right to reject or cancel any order, or terminate the contract with you (with no liability if you’re a business customer), should these standards be breached.

By submitting Artwork, you grant Shirt Monkey a royalty-free license to use, reproduce, adapt, and publish the Artwork (and allow our service providers to do the same) to fulfil your order and promote our products and services. This may include making minor modifications to fit the requirements of the ordered product.

You acknowledge that you have no ownership rights in the digitalised Artwork files created by Blue Asterisk*. These files are created solely for production purposes (e.g., printing or embroidery patterns), and Blue Asterisk* will only use them in accordance with our obligations to you. Blue Asterisk* retains all ownership rights to these files.

However, exact colour matching cannot be guaranteed due to the limitations of the production process, and you agree to accept these limitations. Personalisation is completed manually, and while we will position the Artwork as close to your design as possible, exact placement cannot be guaranteed. You cannot reject or return Products based on these variations unless they materially deviate from the description in your order.

The quality of personalisation depends on the quality of the submitted Artwork. Acceptable file formats include: png. Word documents and similar formats are not accepted. Maximum upload size is 125MB. We recommend Artwork be at least 300 DPI. If the quality is insufficient, we will contact you for a replacement file or confirmation to proceed as is. If we cannot reach you, we may either proceed or hold the order at our discretion. Blue Asterisk* is not responsible for poor-quality outcomes due to low-resolution Artwork or unsupported formats, even if we do not reach out. Returns or refunds cannot be issued in such cases.

CANCELLATION

You do not have the right to cancel orders for personalised products or orders placed as a business customer. All orders with Shirt Monkey are considered bespoke and made to order.

FAULTY PRODUCTS

Blue Asterisk* guarantees that our products will materially match the key characteristics described on our website or marketing materials (including brand, colour, size, style, and material). Please note that colours may appear differently on screens compared to the final product. Slight variations in product or print colour do not constitute a fault. By placing an order, you agree to these terms, including verifying the listed sizes, as differences in sizing across brands will not be considered faults unless they deviate from the stated dimensions. Faults must be reported within 14 days of receiving your order.

SHIPMENT DELAYS

We strive for timely delivery but cannot be held liable for delays caused by shipping providers, natural disasters, or other unforeseen events. No refunds will be issued for shipping-related delays. Once your order is handed to the carrier, we will provide tracking and assist where possible, but delays fall outside our responsibility.

CUSTOMER-SUPPLIED GARMENTS PRINTING POLICY

Blue Asterisk* allows customers to provide their own garments for printing, under the following conditions:

  1. No Refunds or Guarantees: We do not guarantee print quality or offer refunds for customer-supplied garments.

  2. Garment Assessment: We reserve the right to inspect and reject garments deemed unsuitable for printing.

  3. Customer Responsibility: Customers must ensure garments are clean and in good condition. We are not liable for print issues arising from garment condition.

  4. Print Quality: Variability in garment materials may affect print results. We cannot guarantee quality equal to our standard blanks.

  5. No Reprints or Refunds: We do not offer reprints or refunds for customer-supplied garments, including for the cost of the blank garment.

  6. Consent: By proceeding, customers agree to this policy and waive any related claims.

For optimal results, we recommend using our provided garments.

CLIENT-SUPPLIED MATERIALS STORAGE & DISPOSAL POLICY

If you supply us with materials (e.g., labels, inserts, transfers), we will store them for up to six (6) months. If no orders are placed during this period, or the business relationship ends, Blue Asterisk* reserves the right to dispose of these items without notice. Clients must arrange retrieval before the storage period ends.
